Terms of Service

1. Acceptance of terms

By registering and using BlueProfit you accept these Terms of Service in full. If you disagree with any of the terms, you must not use the service.

2. Description of the service

BlueProfit is a predictive fishing abundance mapping platform based on machine learning models. The service includes access to weekly CPUE prediction maps, oceanographic data and analysis tools, according to the contracted plan.

Predictions are indicative and do not constitute a guarantee of catches. BlueProfit is not responsible for operational decisions made based on the data provided.

3. Registration and account

To access the service you must create an account with accurate information. You are responsible for maintaining the confidentiality of your credentials and all activities carried out from your account.

Notify us immediately at contact@blueprofitfish.com if you detect unauthorised access.

4. Plans and billing

• Trial period: all plans include 14 free days. A card is required to activate the trial, but no charge is made until the trial period ends. Users may cancel at any time before expiry at no cost.
• Billing: paid plans are billed monthly via Stripe. The charge is made at the start of each period.
• Automatic renewal: the subscription renews automatically unless cancelled before the end of the current period.
• Plan change: you may change plans at any time. The change takes effect in the next billing cycle.
• Cancellation: you may cancel at any time from your account. No penalties or cancellation charges apply.

5. Refund policy

Payments made are non-refundable except in cases of technical error attributable to BlueProfit. If you experience a problem with the service, contact us at contact@blueprofitfish.com and we will resolve it.

6. Acceptable use

The following are prohibited:

• Sharing access credentials with third parties.
• Mass scraping of data or using the service in an automated manner without express authorisation.
• Redistributing or reselling BlueProfit data or predictions without prior agreement.
• Using the service for illegal activities or activities that harm third parties.

7. Intellectual property

All BlueProfit models, algorithms, visualisations and content are the exclusive property of BlueProfit and are protected by applicable intellectual property legislation. Third-party oceanographic data (Copernicus, EMODnet) is used under their respective licences.

8. Limitation of liability

BlueProfit is provided "as is" and does not guarantee uninterrupted availability of the service. In no event shall BlueProfit's liability exceed the amount paid by the user in the 3 months prior to the event giving rise to the claim.

9. Service modifications

We reserve the right to modify, suspend or discontinue the service with a minimum of 30 days' notice, except in cases of force majeure or legal requirements.

10. Applicable law

These terms are governed by Spanish law. Any dispute shall be submitted to the courts and tribunals of Spain, with express waiver of any other jurisdiction.
