Terms of Service

1. Acceptance of terms

By registering and using BlueProfit you accept these Terms of Service in full. If you disagree with any of them, do not use the service. The owner of the service is stated in the Legal notice.

2. Description of the service

BlueProfit is a daily basket report for bottom trawlers: for each 5 km area, the expected euros per haul of the basket, for today and the next 4 days, with the best spots ready for the plotter. It also includes a hake map, sea layers (Copernicus data) and daily reports.

The report is a guide, not a guarantee of catches: it shows which areas rank higher, and the call is the skipper’s. BlueProfit is not responsible for fishing decisions taken on the basis of the report.

3. Registration and account

To access the service you must create an account with accurate information. You are responsible for keeping your credentials confidential and for everything done from your account. A new account only sees the demo.

Notify us immediately at contacto@blueprofitfish.com if you detect unauthorised access.

4. Price, payment and access

• Price and terms: agreed in writing in a tailored proposal for each vessel. There is no public price list.
• Payment: by bank transfer, against invoice.
• Access: BlueProfit activates access once the proposal is accepted.
• Duration and termination: as set out in the proposal.

5. Refund policy

Payments made are non-refundable except in cases of technical error attributable to BlueProfit. If you have a problem with the service, write to contacto@blueprofitfish.com and we will sort it out.

6. Acceptable use

The following are prohibited:

• Sharing access credentials with third parties.
• Mass copying of data or using the service in an automated manner without express authorisation.
• Redistributing or reselling BlueProfit reports or data without prior agreement.
• Using the service for illegal activities or activities that harm third parties.

7. Intellectual property

BlueProfit’s reports, maps, visualisations and content belong to its owner (see Legal notice) and are protected by applicable intellectual property law. Third-party sea data (Copernicus) is used under its licence.

8. Limitation of liability

BlueProfit is provided “as is” and does not guarantee uninterrupted availability. In no event shall BlueProfit’s liability exceed the amount paid by the user in the 3 months prior to the event giving rise to the claim.

9. Service modifications

We reserve the right to modify, suspend or discontinue the service with a minimum of 30 days’ notice, except in cases of force majeure or legal requirement.

10. Applicable law

These terms are governed by Spanish law. Any dispute shall be submitted to the courts of Spain, with express waiver of any other jurisdiction.
